Tomato rule
Per Wikipedia: “Vegetables are edible parts of plants that are consumed by humans or other animals as food. This original meaning is still commonly used, and is applied to plants collectively to refer to all edible plant matter, including flowers, fruits, stems, leaves, roots, and seeds.”
I’ve always tackled this problem by seeing it differently depending on the context, “culinary” or “scientific” . Scientifically, a Jalapeño is a fruit, but culinarily it is a vegetable. Same with other foods like tomato being a fruit or cucumber being a berry. They’re just vegetables in a cooking context but not in a scientific one
